Terms and Conditions

Stoddart Design will provide all our Customers with a professional design and print service at a reasonable cost. Our terms and conditions will apply to all work carried out by Stoddart Design.

Stoddart Design reserves the right to change these terms and conditions at any time. Any such changes will take effect when posted on this website and it is the responsibility of the Customer (you) to read the terms and conditions on each occasion you use the website and your continued use of the website shall signify your acceptance to be bound by the latest terms and conditions.

Supply of Information and Text

The Customer is also responsible for ensuring that all information supplied is in a usable format and accurate to the best of your knowledge, having spell checked any text in order to minimise amendments and reproofing. We would request that you advise us as soon as possible of any changes to information already provided to us and also any change in circumstances that may affect the work in hand.

The Customer is responsible for ensuring that you have permission to use any material such as photography or other imagery that you ask Stoddart Design to use.

In any orders where items belonging to the Customer have been supplied to Stoddart Design e.g photographs, drawings etc. for use in the design of any printed products Stoddart Design will strive to ensure that these items are returned in exactly the same condition as they were received. However, should any loss or damage occur to any such items Stoddart Design cannot be held responsible. Any such items supplied for use will be assumed to be owned by the customer and will be accepted by Stoddart Design as giving full permission for their use.

The Customer will be responsible for any illegal reproduction undertaken due to incorrect licensing or breach of copyright laws.

Timings

We will advise you of an approximate time to get first designs / visuals to you and once approved a print delivery date. We will always endeavour to meet your required timescale wherever possible. If information required from any Customer is not supplied when requested then Stoddart Design cannot be held responsible for any resultant delays or failure to meet any deadline agreed when the order was placed.

Unfortunately, timings may change due to circumstances beyond our control, but we will inform you of this should that be the case.

Charges, Prices and Payment

Our charges will be fair and will take into account the complexity of the work involved and the time required or spent to complete the project. We have a minimum charge period of 30 minutes for any order.

Any quotation supplied by Stoddart Design is based on the information received from the Customer at the time of placing the order. Quotes include a maximum of two sets of amendments/ corrections and two sets of proofs. Amendments in excess of this will need to be charged at our hourly rate and we will advise you (the Customer) accordingly.

All quotes given are valid for a period of 30 days from the date of the quote.

Rush charges may apply for projects with a quick deadline or turnaround time and we will advise Customers of these should they apply.

Payment is required before work commences unless otherwise agreed.

Payment is accepted by debit or credit card through PayPal (3.5% charge), bank transfer, cheque or cash.

All goods remain the property of Stoddart Design until payment in full has been received.

Customers must contact us within 7 days of the date of an invoice if there is any error or they have a complaint.

All designs and artwork are the copyright of Stoddart Design. All rights reserved.

Stoddart Design reserves the right to feature your design and/or printed copy of it on any promotional and marketing material and on the Stoddart Design website, social media or blog (discretionary).

Proofs

A proof of your design/artwork will be sent as PDF file via email for checking and approval before printing. Stoddart Design will check wording, grammar and spelling prior to sending the PDF proof but the checking of any proofs is totally the responsibility of the Customer. Any changes required must be emailed or phoned through and the proof rechecked.

Please note that colour visible on screen on our website, social media and in electronic proofs may differ slightly from printed colour on the final goods. This is due to the non-uniform colour configuration on computer screens and the fact that screen colours are generated in an entirely different way to printed colours.

Stoddart Design requires that, once you (the Customer) have checked the proof and are happy to go to print, you confirm this via email. Once you have approved the final proof, you bear the responsibility of the design and typographical elements of your artwork. If items are approved with text, typo or any other errors, Stoddart Design takes no responsibility and will not bear the costs of reprinting or issue a refund. If reprinting is required it will be charged for in full.

Lead times vary but in a small number of cases, printing can occur as quickly as the same day as final approval, so any subsequent corrections, not mentioned before final approval will result in the additional/amended versions be charged on top of the original order.

Any errors that result as a fault of Stoddart Design will be rectified at cost to us and replacement printing supplied. 

Orders

We will keep you informed of the progress of any design or print order placed with us. However, you are free to contact us at any time by either phone or email with any queries or questions you may have.

Cancellation

Cancellation of a design or print order will be subject to any costs incurred and full order costs will be charged if the design has been approved and printed. If the order has been cancelled before printing has commenced then the print costs will not be charged unless paper has been specifically purchased for that order.

Events Beyond Our Reasonable Control

Stoddart Design shall be under no liability if unable to carry out their obligations in relation to any order for any cause beyond its reasonable control.

The following are regarded as causes beyond reasonable control of Stoddart Design: 

a state of war, riot, civil disorder, fire, industrial dispute or strike, accidents, energy failure, equipment breakdown, delays in shipment by suppliers or carriers, action of government or civil authority, acts of God and any other causes not included here that are beyond the control of the Customer or Stoddart Design. This condition does not affect your statutory rights.

However it accepts no liability for any inaccuracies, errors or omissions in the site through technical or other reasons. We reserve the right at any time and without prior notice to make changes and corrections to the material on the site.

Stoddart Design does not guarantee the functions of the site will be uninterrupted or error-free. Due to the nature of the web and whilst we have a Firewall installed on the site, we cannot guarantee it will be free of viruses or other harmful components.

Stoddart Design bears no responsibility for any experiences or transactions the purchaser may have with any of these.

General

The validity and enforceability of this agreement will be interpreted with the laws of Scotland but Stoddart Design reserves the right to bring proceedings in connection with this contract in any other court of competent jurisdiction. Failure by Stoddart Design to enforce any of these conditions shall not be construed as a waiver of that condition or any other condition.

We at Stoddart Design pride ourselves on our customer service and the quality of our products. We want you to be happy with all of the products you have purchased from us and therefore in the event of any dissatisfaction please contact us and we will do our very best to put things right.

Privacy Policy

Customer Details/Personal Information

All personal information collected from customers is kept safe and secure. We operate a robust Firewall system on our website which protects it, to the highest standard, from viruses and other alien attacks. We like to ensure that our website is absolutely secure when it comes to the collection and use of personal information.

To process orders we need certain information including, name, address, phone number and email address. All debit and credit card payments are processed through PayPal using their own secure system.

Customer details will not be passed on to any third party and we will not allow any third party access to your information at any point in time.

We may like to contact you to keep you informed of new developments within our own service or new products and ideas. If you do not want this service then please contact us.
